If my Spanish house is empty all year, do I still have to file?

Yes. The obligation comes from owning, not from receiving rent.

It is the question that reaches us most often, and almost always with the same sentence behind it: “but I earn nothing from it”.

Why you declare something you do not receive

Because the law does not tax only what you earn: it also taxes the fact of having a dwelling in Spain at your disposal while living elsewhere. That is called imputed income, and it is declared on the modelo 210 just as rent would be, only with a different calculation.

What usually happens when nobody files

Nothing, for a while. No one calls, no one writes, and the owner reasonably concludes there was nothing to do. The notice arrives years later, by letter, at the closed house, and by then the amount carries a surcharge.

That is precisely why this obligation is discovered late: administrative silence does not mean agreement, it means they have not looked at you yet.
