There are two of us on the deed. Is one return enough?
No. Each owner files their own share, separately.
It is one of the easiest mistakes to make and one of the quietest: the return that was filed does not cover the other person, and nobody points it out.
One return per person, not per property
Where a property belongs to several people, each declares the share corresponding to their percentage of ownership. A couple owning fifty-fifty file two returns; three siblings owning a third each, three.
The percentage is on the deed. It is not divided by agreement between the owners: it is divided as registered.
Why the mistake does not surface by itself
Because the return that was filed is valid: that person's is fine. What is missing is the other co-owner's, and an absence generates no acknowledgement.
It usually comes to light on the day of a sale, an inheritance, or when somebody looks back.
