What happens if I overstay the 90 days in Schengen?
It is recorded, and the first thing you need is the exact count in writing.

What has changed
Since 10 April 2026, entries and exits are recorded electronically. Before, an overstay could pass unnoticed if the stamp was illegible or nobody looked. Now a database keeps the count, and it does not depend on luck at the border.
What Spanish law provides
Being in Spain without the stay or the permit that applies is a serious infraction: that is article 53.1.a) of Ley Orgánica 4/2000. And for a serious infraction, article 55.1.b) provides a fine of between 501 and 10,000 euros.
Article 57.1 lets the administration apply that fine or, instead of it, removal from the territory, by reasoned decision and after proceedings. Which of the two follows depends on the file, not on a website, and we are not going to guess it here.
One more thing worth knowing before you travel again: a refusal of entry at the border is recorded in the European system too, exactly like entries and exits.
The first step, and it is not calling anyone
It is knowing by how many days you have overstayed and from when you may enter again, in writing, with the real dates from your tickets. That count is exactly the first thing any lawyer will ask you for, and doing it is free here.
